These Terms of Service ("Terms") govern your use of the Staxx mobile application and related services (the "Service"), operated by Staxx Money LLC, a New Jersey limited liability company ("Staxx," "we," "us").
By creating an account or using Staxx, you agree to these Terms. If you don't agree, don't use the Service.
1. Who can use Staxx
You must be at least 18 years old and able to enter into a binding contract. You must be a resident of the United States and have accounts at financial institutions supported by our data provider.
You agree to provide accurate information and to keep your account credentials secure. You're responsible for activity that occurs under your account.
2. What Staxx is — and what it isn't
Staxx helps you understand how much money is available to spend by subtracting what you've spent, what's reserved for bills, and what's set aside for goals from your income.
Staxx is not a financial advisor, and Staxx does not provide financial, investment, tax, or legal advice.
The figures Staxx displays — including your safe-to-spend amount, spending pace, and any answers provided by the Ask Staxx feature — are calculations based on data from your connected accounts and information you've entered. They describe your situation; they are not recommendations about what you should do. Ask Staxx answers whether an amount fits within your available funds. It does not advise you on whether a purchase is wise.
You are responsible for your own financial decisions. Do not rely solely on Staxx when making them.
Staxx is not a bank. We do not hold, transfer, or have the ability to move your money. We do not extend credit. Staxx reads account information; it cannot initiate transactions.
3. Accuracy
We work to make Staxx accurate, but the Service depends on data supplied by third parties and by you.
- Transaction data comes from your financial institutions through Plaid. It may be delayed, incomplete, miscategorized, or occasionally incorrect.
- Pending transactions may change or disappear when they settle.
- Calculations depend on the accuracy of the income, bills, and goals you enter.
- Balances shown may not reflect transactions that haven't posted yet.
Always verify with your financial institution before making decisions that depend on exact figures. Staxx does not guarantee that displayed information is accurate, complete, or current.
4. Connecting financial accounts
Staxx uses Plaid Inc. to connect to your financial institutions. By connecting an account, you also agree to Plaid's end user privacy policy at plaid.com/legal.
You represent that you have the right to access and provide the credentials for any account you connect. You may disconnect any institution at any time from within the app.
5. Subscription and payment
Staxx costs $7.99 per month.
Billing. Subscriptions are purchased and managed through the Apple App Store. Payment is charged to your Apple Account at confirmation of purchase. We never receive or store your payment card details.
Automatic renewal. Your subscription renews automatically each month unless you cancel at least 24 hours before the end of the current period. Your Apple Account is charged for renewal within 24 hours prior to the end of the period.
Cancellation. You can cancel at any time through your device's Settings → your Apple Account → Subscriptions. Cancellation takes effect at the end of the current billing period. You'll retain access until then.
Cancelling your subscription and deleting your Staxx account are separate actions. Deleting your account does not cancel billing. Cancel your subscription first.
Refunds are handled by Apple in accordance with App Store policy. We cannot process refunds for purchases made through the App Store.
Price changes. We may change the subscription price. We'll give you notice before any change takes effect, and it will apply only to subsequent billing periods. Continuing to use the Service after a price change takes effect means you accept the new price.

6. Your content and data
You retain ownership of the information you provide. You grant us a limited license to store, process, and display that information as necessary to operate the Service.
Our handling of your data is described in our Privacy Policy, which forms part of these Terms.
7. Acceptable use
You agree not to:
- Use Staxx for any unlawful purpose
- Access accounts you're not authorized to access
- Attempt to gain unauthorized access to our systems or other users' data
- Reverse engineer, decompile, or attempt to extract source code from the app
- Interfere with or disrupt the Service, or attempt to circumvent rate limits or security measures
- Use automated systems to access the Service in a way that sends more requests than a person could reasonably produce
- Resell, sublicense, or commercially exploit the Service
8. Intellectual property
Staxx, including the app, its design, and the Staxx name and marks, is owned by Staxx Money LLC and protected by intellectual property law. These Terms grant you a limited, non-exclusive, non-transferable, revocable license to use the app for personal, non-commercial purposes. No other rights are granted.
9. Termination
By you. You may stop using Staxx at any time and request account deletion as described in our Privacy Policy. Cancel your subscription through Apple separately.
By us. We may suspend or terminate your access if you violate these Terms, if we're required to by law, or if we discontinue the Service. Where practical, we'll give you notice. If we terminate your account without cause, you may be entitled to a prorated refund through Apple.
Sections 2, 3, 8, 10, 11, 12, and 13 survive termination.
10. Disclaimers
THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE," WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.
We do not warrant that the Service will be uninterrupted, error-free, secure, or that data displayed will be accurate or complete. We are not responsible for the availability, accuracy, or actions of third-party services including Plaid and your financial institutions.
Some jurisdictions don't allow the exclusion of certain warranties, so some of the above may not apply to you.
11. Limitation of liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, STAXX MONEY LLC WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, DATA, OR GOODWILL, ARISING FROM OR RELATING TO YOUR USE OF THE SERVICE.
This includes financial decisions you make based on information displayed in Staxx, including overdrafts, missed payments, or shortfalls resulting from inaccurate, delayed, or incomplete data.
OUR TOTAL LIABILITY FOR ANY CLAIM RELATING TO THE SERVICE WILL NOT EXCEED THE GREATER OF (A) THE AMOUNT YOU PAID US IN THE TWELVE MONTHS PRECEDING THE CLAIM, OR (B) ONE HUNDRED DOLLARS ($100).
Some jurisdictions don't allow certain limitations of liability, so some of the above may not apply to you.
12. Indemnification
You agree to indemnify and hold harmless Staxx Money LLC and its members from any claim, loss, liability, or expense (including reasonable attorneys' fees) arising from your use of the Service, your violation of these Terms, or your violation of any law or third-party right.
13. Governing law and disputes
These Terms are governed by the laws of the State of New Jersey, without regard to conflict of laws principles. Any dispute will be brought in the state or federal courts located in New Jersey, and you consent to their jurisdiction.
[CONSIDER: an arbitration clause and class action waiver. Common in consumer fintech terms and worth discussing with counsel, as enforceability and required notice provisions vary by state.]
14. Apple-specific terms
These Terms are between you and Staxx Money LLC, not Apple. Apple is not responsible for the app or its content. Apple has no obligation to provide support for the app. In the event of any failure of the app to conform to a warranty, you may notify Apple, and Apple will refund your purchase price; Apple has no other warranty obligation. Apple is not responsible for addressing any claim relating to the app, including product liability, legal or regulatory compliance, or consumer protection claims. Apple and its subsidiaries are third-party beneficiaries of these Terms and may enforce them against you.
15. General
Entire agreement. These Terms and the Privacy Policy are the entire agreement between you and Staxx regarding the Service.
Changes. We may update these Terms. We'll notify you of material changes before they take effect. Continued use after they take effect means you accept them.
Severability. If any provision is unenforceable, the rest remains in effect.
No waiver. Our failure to enforce a provision isn't a waiver of it.
Assignment. You may not assign these Terms. We may assign them in connection with a merger, acquisition, or sale of assets.
